Workspace is a web-based AI-assisted job matching platform that enables individuals and companies to manage job postings, applications, and recruiting workflows.

2. Eligibility
You must be at least 18 years old to use Workspace.
By using the platform, you confirm that:

• You have the legal capacity to enter into binding agreements.
• You are not prohibited from using the service under applicable law.

3. Accounts and Registration
To access certain features, you must create an account.
You agree to:

• Provide accurate and complete information.
• Keep your login credentials secure.
• Notify us immediately of unauthorized access.

We use Clerk for authentication and account management.

4. Use of the Service
You may use Workspace only for lawful purposes.
You agree not to:

• Violate any applicable law or regulation.
• Upload false, misleading, or unlawful content.
• Attempt to gain unauthorized access to the platform.
• Use the service for spam, scraping, or automated abuse.

5. AI Functionality
Workspace uses artificial intelligence technologies, including OpenAI services, to analyze job descriptions and candidate profiles.
AI-generated outputs:

• Are based on probabilistic models.
• May contain inaccuracies.
• Should not replace independent professional judgment.

Workspace does not guarantee hiring outcomes.

6. Data Processing Roles
Where recruiters or companies use Workspace:

• The company acts as the Data Controller.
• Workspace acts as the Data Processor under Article 28 GDPR.

Workspace processes personal data only according to documented instructions.

7. Content Ownership
Users retain ownership of:

• CVs
• Job descriptions
• Uploaded materials

By uploading content, you grant Workspace a limited license to process and display the content for the purpose of providing the service.

8. Anonymized Data
Workspace may use anonymized and aggregated data to:

• Improve the platform
• Generate hiring insights
• Publish market reports

No personally identifiable information will be disclosed.

9. Subscriptions and Payments (Future Plans)
Workspace currently offers free access.
Paid plans may be introduced in the future. If so:

• Pricing will be clearly displayed.
• Subscriptions may renew automatically unless canceled.
• Users will be notified in advance.

10. Suspension and Termination
We may suspend or terminate accounts if:

• These Terms are violated
• Illegal activities are detected
• Platform security is compromised

Users may delete their accounts at any time.

11. Disclaimer of Warranties
Workspace is provided “as is” and “as available.”
We do not guarantee:

• Continuous availability
• Error-free operation
• Specific hiring outcomes

12. Limitation of Liability
To the extent permitted by law, Workspace shall not be liable for:

• Indirect or consequential damages
• Lost profits
• Data loss beyond our reasonable control

Liability under German law remains unaffected where mandatory.

13. Changes to the Terms
We may update these Terms from time to time.
Users will be notified via email or platform notice. Continued use constitutes acceptance.

14. Governing Law
These Terms are governed by the laws of Germany.
Jurisdiction: Berlin, Germany, unless mandatory consumer protection laws apply.
